The Rights of Non-Muslims in Islam

 

Islam is a religion of justice, mercy, and coexistence, and its teachings encompass the rights and responsibilities of all individuals, including non-Muslims. Rooted in the Quran and the teachings of the Prophet Muhammad ﷺ, the principles of Islamic governance and social interactions are designed to ensure harmony and respect among diverse communities. The Quran emphasizes the inherent dignity of all human beings:

وَلَقَدْ كَرَّمْنَا بَنِي آدَمَ
“And We have certainly honored the children of Adam.”
(Surah Al-Isra, 17:70)

This honor is not restricted by faith, nationality, or ethnicity. Non-Muslims living under Islamic governance are entitled to specific rights, including freedom of religion, protection of life and property, and fair treatment.

The Prophet Muhammad ﷺ also exemplified these values in his dealings with non-Muslims. He said:

مَنْ ظَلَمَ مُعَاهِدًا أَوِ انْتَقَصَهُ حَقًّا أَوْ كَلَّفَهُ فَوْقَ طَاقَتِهِ أَوْ أَخَذَ مِنْهُ شَيْئًا بِغَيْرِ طِيبِ نَفْسٍ فَأَنَا حَجِيجُهُ يَوْمَ الْقِيَامَةِ
“Whoever oppresses a person under a covenant or diminishes their rights… I will argue against them on the Day of Judgment.”
(Sunan Abu Dawood, Hadith 3052)

Freedom of Religion

 

Islam recognizes the diversity of beliefs and emphasizes that faith is a personal choice. Coercion in matters of faith is strictly prohibited. The Quran states:

لَا إِكْرَاهَ فِي الدِّينِ قَدْ تَبَيَّنَ الرُّشْدُ مِنَ الْغَيِّ
“There is no compulsion in religion. Verily, the right path has become distinct from the wrong path.”
(Surah Al-Baqarah, 2:256)

This verse underscores that accepting Islam must be a voluntary decision. Non-Muslims living under Islamic governance are not compelled to convert and are free to practice their religion.


The rights of non-Muslims in Islam

Protection of Life and Property

 

Islam mandates the protection of the lives, properties, and honor of non-Muslims. The Prophet Muhammad ﷺ emphasized this in various hadiths:

مَنْ قَتَلَ مُعَاهِدًا لَمْ يَرَحْ رَائِحَةَ الْجَنَّةِ
“Whoever kills a person under a covenant (a non-Muslim under Muslim protection) will not smell the fragrance of Paradise.”
(Sahih al-Bukhari, Hadith 3166)

This stern warning highlights the sanctity of the lives of non-Muslims under Islamic protection. Their properties and places of worship are equally safeguarded.

وَلَوْلَا دَفْعُ اللَّهِ النَّاسَ بَعْضَهُمْ بِبَعْضٍ لَهُدِّمَتْ صَوَامِعُ وَبِيَعٌ وَصَلَوَاتٌ وَمَسَاجِدُ يُذْكَرُ فِيهَا اسْمُ اللَّهِ كَثِيرًا
“And if Allah did not repel some people by means of others, monasteries, churches, synagogues, and mosques, wherein the name of Allah is often mentioned, would have been demolished.”
(Surah Al-Hajj, 22:40)

This verse emphasizes the protection of places of worship, regardless of the faith they represent.


Justice and Equality

 

Justice is a fundamental principle in Islam, and it extends to all individuals, regardless of their religion. The Quran commands Muslims to uphold justice even when dealing with those who oppose them:

يَا أَيُّهَا الَّذِينَ آمَنُوا كُونُوا قَوَّامِينَ لِلَّهِ شُهَدَاءَ بِالْقِسْطِ وَلَا يَجْرِمَنَّكُمْ شَنَآنُ قَوْمٍ عَلَىٰ أَلَّا تَعْدِلُوا اعْدِلُوا هُوَ أَقْرَبُ لِلتَّقْوَىٰ
“O you who have believed, be persistently standing firm for Allah, witnesses in justice, and do not let the hatred of a people prevent you from being just. Be just; that is nearer to righteousness.”
(Surah Al-Ma’idah, 5:8)

The Prophet Muhammad ﷺ also demonstrated this principle in his life. He judged fairly between Muslims and non-Muslims, ensuring equality and fairness in all dealings.


Economic Rights and Fair Treatment

 

Non-Muslims under Islamic governance have economic rights. They are allowed to engage in business, own property, and enter into contracts. They are also entitled to state protection and public services.

The concept of jizya (a tax levied on non-Muslims in return for protection and exemption from military service) is often misunderstood. It is a symbolic gesture of allegiance to the state and a substitute for the zakat tax that Muslims pay. Non-Muslims who cannot afford to pay are exempted, as evidenced by historical examples from the caliphate of Umar ibn al-Khattab.

وَإِنْ أَحَدٌ مِنَ الْمُشْرِكِينَ اسْتَجَارَكَ فَأَجِرْهُ حَتَّى يَسْمَعَ كَلَامَ اللَّهِ ثُمَّ أَبْلِغْهُ مَأْمَنَهُ ذَلِكَ بِأَنَّهُمْ قَوْمٌ لَا يَعْلَمُونَ
“And if any one of the polytheists seeks your protection, then grant him protection so that he may hear the words of Allah. Then deliver him to his place of safety. That is because they are a people who do not know.”
(Surah At-Tawbah, 9:6)

This verse illustrates the principle of ensuring safety and well-being for those seeking refuge, irrespective of their faith.


Social and Cultural Rights

 

Islam encourages Muslims to maintain harmonious relations with non-Muslims, showing kindness and respect. The Quran advises:

لَا يَنْهَاكُمُ اللَّهُ عَنِ الَّذِينَ لَمْ يُقَاتِلُوكُمْ فِي الدِّينِ وَلَمْ يُخْرِجُوكُمْ مِنْ دِيَارِكُمْ أَنْ تَبَرُّوهُمْ وَتُقْسِطُوا إِلَيْهِمْ إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ
“Allah does not forbid you from being righteous and just toward those who have not fought you because of religion and have not expelled you from your homes. Indeed, Allah loves those who act justly.”
(Surah Al-Mumtahanah, 60:8)

This verse advocates kindness and equity towards non-Muslims who live peacefully with Muslims. The Prophet Muhammad ﷺ exemplified this through his interactions with Jews and Christians, engaging in dialogue and forming treaties for mutual benefit.


Rights During Conflict

 

Even during times of war, Islam establishes clear guidelines to ensure humane treatment of non-Muslims. The Prophet Muhammad ﷺ instructed his companions:

اغْزُوا بِاسْمِ اللَّهِ، وَلَا تَقْتُلُوا شَيْخًا فَانِيًا، وَلَا طِفْلًا صَغِيرًا، وَلَا امْرَأَةً، وَلَا تَغُلُّوا، وَلا تَغْدِرُوا
“Fight in the name of Allah, but do not kill the elderly, children, or women, and do not steal or betray.”
(Sunan Abu Dawood, Hadith 2613)

Islam prohibits targeting non-combatants and destroying crops, homes, or infrastructure. This is a manifestation of mercy and justice even during warfare.

“Indeed, Allah commands justice and good conduct.”
(Surah An-Nahl, 16:90)

The Prophet Muhammad ﷺ reinforced this by stating:
