The Rights of Non-Muslims in Islam

Islam is a religion of justice, mercy, and coexistence, and its teachings encompass the rights and responsibilities of all individuals, including non-Muslims. Rooted in the Quran and the teachings of the Prophet Muhammad īˇē, the principles of Islamic governance and social interactions are designed to ensure harmony and respect among diverse communities. The Quran emphasizes the inherent dignity of all human beings:

ŲˆŲŽŲ„ŲŽŲ‚ŲŽØ¯Ų’ ŲƒŲŽØąŲŽŲ‘Ų…Ų’Ų†ŲŽØ§ بŲŽŲ†ŲŲŠ ØĸدŲŽŲ…ŲŽ
“And We have certainly honored the children of Adam.”
(Surah Al-Isra, 17:70)

This honor is not restricted by faith, nationality, or ethnicity. Non-Muslims living under Islamic governance are entitled to specific rights, including freedom of religion, protection of life and property, and fair treatment.

The Prophet Muhammad īˇē also exemplified these values in his dealings with non-Muslims. He said:

Ų…ŲŽŲ†Ų’ ظŲŽŲ„ŲŽŲ…ŲŽ Ų…ŲØšŲŽØ§Ų‡ŲØ¯Ų‹Ø§ ØŖŲŽŲˆŲ اŲ†Ų’ØĒŲŽŲ‚ŲŽØĩŲŽŲ‡Ų ØŲŽŲ‚Ų‘Ų‹Ø§ ØŖŲŽŲˆŲ’ ŲƒŲŽŲ„ŲŽŲ‘ŲŲŽŲ‡Ų ŲŲŽŲˆŲ’Ų‚ŲŽ ØˇŲŽØ§Ų‚ŲŽØĒŲŲ‡Ų ØŖŲŽŲˆŲ’ ØŖŲŽØŽŲŽØ°ŲŽ Ų…ŲŲ†Ų’Ų‡Ų Ø´ŲŽŲŠŲ’ØĻŲ‹Ø§ بŲØēŲŽŲŠŲ’ØąŲ ØˇŲŲŠØ¨Ų Ų†ŲŽŲŲ’ØŗŲ ŲŲŽØŖŲŽŲ†ŲŽØ§ ØŲŽØŦŲŲŠØŦŲŲ‡Ų ŲŠŲŽŲˆŲ’Ų…ŲŽ اŲ„Ų’Ų‚ŲŲŠŲŽØ§Ų…ŲŽØŠŲ
“Whoever oppresses a person under a covenant or diminishes their rights… I will argue against them on the Day of Judgment.”
(Sunan Abu Dawood, Hadith 3052)

This introduction sets the foundation for exploring the comprehensive rights Islam guarantees to non-Muslims, reflecting the religion’s commitment to justice and mutual respect.

Freedom of Religion

Islam recognizes the diversity of beliefs and emphasizes that faith is a personal choice. Coercion in matters of faith is strictly prohibited. The Quran states:

Ų„ŲŽØ§ ØĨŲŲƒŲ’ØąŲŽØ§Ų‡ŲŽ ŲŲŲŠ اŲ„دŲŲ‘ŲŠŲ†Ų Ų‚ŲŽØ¯Ų’ ØĒŲŽØ¨ŲŽŲŠŲŽŲ‘Ų†ŲŽ اŲ„ØąŲŲ‘Ø´Ų’دŲ Ų…ŲŲ†ŲŽ اŲ„Ų’ØēŲŽŲŠŲŲ‘
“There is no compulsion in religion. Verily, the right path has become distinct from the wrong path.”
(Surah Al-Baqarah, 2:256)

This verse underscores that accepting Islam must be a voluntary decision. Non-Muslims living under Islamic governance are not compelled to convert and are free to practice their religion.

The rights of non-Muslims in Islam

Protection of Life and Property

Islam mandates the protection of the lives, properties, and honor of non-Muslims. The Prophet Muhammad īˇē emphasized this in various hadiths:

Ų…ŲŽŲ†Ų’ Ų‚ŲŽØĒŲŽŲ„ŲŽ Ų…ŲØšŲŽØ§Ų‡ŲØ¯Ų‹Ø§ Ų„ŲŽŲ…Ų’ ŲŠŲŽØąŲŽØŲ’ ØąŲŽØ§ØĻŲØŲŽØŠŲŽ اŲ„Ų’ØŦŲŽŲ†ŲŽŲ‘ØŠŲ
“Whoever kills a person under a covenant (a non-Muslim under Muslim protection) will not smell the fragrance of Paradise.”
(Sahih al-Bukhari, Hadith 3166)

This stern warning highlights the sanctity of the lives of non-Muslims under Islamic protection. Their properties and places of worship are equally safeguarded.

ŲˆŲŽŲ„ŲŽŲˆŲ’Ų„ŲŽØ§ دŲŽŲŲ’ØšŲ اŲ„Ų„Ų‘ŲŽŲ‡Ų اŲ„Ų†Ų‘ŲŽØ§ØŗŲŽ بŲŽØšŲ’ØļŲŽŲ‡ŲŲ…Ų’ بŲØ¨ŲŽØšŲ’ØļŲ Ų„ŲŽŲ‡ŲØ¯ŲŲ‘Ų…ŲŽØĒŲ’ ØĩŲŽŲˆŲŽØ§Ų…ŲØšŲ ŲˆŲŽØ¨ŲŲŠŲŽØšŲŒ ŲˆŲŽØĩŲŽŲ„ŲŽŲˆŲŽØ§ØĒŲŒ ŲˆŲŽŲ…ŲŽØŗŲŽØ§ØŦŲØ¯Ų ŲŠŲØ°Ų’ŲƒŲŽØąŲ ŲŲŲŠŲ‡ŲŽØ§ اØŗŲ’Ų…Ų اŲ„Ų„Ų‘ŲŽŲ‡Ų ŲƒŲŽØĢŲŲŠØąŲ‹Ø§
“And if Allah did not repel some people by means of others, monasteries, churches, synagogues, and mosques, wherein the name of Allah is often mentioned, would have been demolished.”
(Surah Al-Hajj, 22:40)

This verse emphasizes the protection of places of worship, regardless of the faith they represent.

Justice and Equality

Justice is a fundamental principle in Islam, and it extends to all individuals, regardless of their religion. The Quran commands Muslims to uphold justice even when dealing with those who oppose them:

ŲŠŲŽØ§ ØŖŲŽŲŠŲŲ‘Ų‡ŲŽØ§ اŲ„ŲŽŲ‘Ø°ŲŲŠŲ†ŲŽ ØĸŲ…ŲŽŲ†ŲŲˆØ§ ŲƒŲŲˆŲ†ŲŲˆØ§ Ų‚ŲŽŲˆŲŽŲ‘اŲ…ŲŲŠŲ†ŲŽ Ų„ŲŲ„ŲŽŲ‘Ų‡Ų Ø´ŲŲ‡ŲŽØ¯ŲŽØ§ØĄŲŽ بŲØ§Ų„Ų’Ų‚ŲØŗŲ’ØˇŲ ŲˆŲŽŲ„ŲŽØ§ ŲŠŲŽØŦŲ’ØąŲŲ…ŲŽŲ†ŲŽŲ‘ŲƒŲŲ…Ų’ Ø´ŲŽŲ†ŲŽØĸŲ†Ų Ų‚ŲŽŲˆŲ’Ų…Ų ØšŲŽŲ„ŲŽŲ‰Ų° ØŖŲŽŲ„ŲŽŲ‘ا ØĒŲŽØšŲ’دŲŲ„ŲŲˆØ§ اؚŲ’دŲŲ„ŲŲˆØ§ Ų‡ŲŲˆŲŽ ØŖŲŽŲ‚Ų’ØąŲŽØ¨Ų Ų„ŲŲ„ØĒŲŽŲ‘Ų‚Ų’ŲˆŲŽŲ‰Ų°
“O you who have believed, be persistently standing firm for Allah, witnesses in justice, and do not let the hatred of a people prevent you from being just. Be just; that is nearer to righteousness.”
(Surah Al-Ma’idah, 5:8)

The Prophet Muhammad īˇē also demonstrated this principle in his life. He judged fairly between Muslims and non-Muslims, ensuring equality and fairness in all dealings.

Economic Rights and Fair Treatment

Non-Muslims under Islamic governance have economic rights. They are allowed to engage in business, own property, and enter into contracts. They are also entitled to state protection and public services.

The concept of jizya (a tax levied on non-Muslims in return for protection and exemption from military service) is often misunderstood. It is a symbolic gesture of allegiance to the state and a substitute for the zakat tax that Muslims pay. Non-Muslims who cannot afford to pay are exempted, as evidenced by historical examples from the caliphate of Umar ibn al-Khattab.

ŲˆŲŽØĨŲŲ†Ų’ ØŖŲŽØŲŽØ¯ŲŒ Ų…ŲŲ†ŲŽ اŲ„Ų’Ų…ŲØ´Ų’ØąŲŲƒŲŲŠŲ†ŲŽ اØŗŲ’ØĒŲŽØŦŲŽØ§ØąŲŽŲƒŲŽ ŲŲŽØŖŲŽØŦŲØąŲ’Ų‡Ų ØŲŽØĒŲŽŲ‘Ų‰ ŲŠŲŽØŗŲ’Ų…ŲŽØšŲŽ ŲƒŲŽŲ„ŲŽØ§Ų…ŲŽ اŲ„Ų„Ų‘ŲŽŲ‡Ų ØĢŲŲ…ŲŽŲ‘ ØŖŲŽØ¨Ų’Ų„ŲØēŲ’Ų‡Ų Ų…ŲŽØŖŲ’Ų…ŲŽŲ†ŲŽŲ‡Ų Ø°ŲŽŲ„ŲŲƒŲŽ بŲØŖŲŽŲ†ŲŽŲ‘Ų‡ŲŲ…Ų’ Ų‚ŲŽŲˆŲ’Ų…ŲŒ Ų„ŲŽØ§ ŲŠŲŽØšŲ’Ų„ŲŽŲ…ŲŲˆŲ†ŲŽ
“And if any one of the polytheists seeks your protection, then grant him protection so that he may hear the words of Allah. Then deliver him to his place of safety. That is because they are a people who do not know.”
(Surah At-Tawbah, 9:6)

This verse illustrates the principle of ensuring safety and well-being for those seeking refuge, irrespective of their faith.

Social and Cultural Rights

Islam encourages Muslims to maintain harmonious relations with non-Muslims, showing kindness and respect. The Quran advises:

Ų„ŲŽØ§ ŲŠŲŽŲ†Ų’Ų‡ŲŽØ§ŲƒŲŲ…Ų اŲ„Ų„Ų‘ŲŽŲ‡Ų ØšŲŽŲ†Ų اŲ„Ų‘ŲŽØ°ŲŲŠŲ†ŲŽ Ų„ŲŽŲ…Ų’ ŲŠŲŲ‚ŲŽØ§ØĒŲŲ„ŲŲˆŲƒŲŲ…Ų’ ŲŲŲŠ اŲ„دŲ‘ŲŲŠŲ†Ų ŲˆŲŽŲ„ŲŽŲ…Ų’ ŲŠŲØŽŲ’ØąŲØŦŲŲˆŲƒŲŲ…Ų’ Ų…ŲŲ†Ų’ دŲŲŠŲŽØ§ØąŲŲƒŲŲ…Ų’ ØŖŲŽŲ†Ų’ ØĒŲŽØ¨ŲŽØąŲ‘ŲŲˆŲ‡ŲŲ…Ų’ ŲˆŲŽØĒŲŲ‚Ų’ØŗŲØˇŲŲˆØ§ ØĨŲŲ„ŲŽŲŠŲ’Ų‡ŲŲ…Ų’ ØĨŲŲ†Ų‘ŲŽ اŲ„Ų„Ų‘ŲŽŲ‡ŲŽ ŲŠŲØŲØ¨Ų‘Ų اŲ„Ų’Ų…ŲŲ‚Ų’ØŗŲØˇŲŲŠŲ†ŲŽ
“Allah does not forbid you from being righteous and just toward those who have not fought you because of religion and have not expelled you from your homes. Indeed, Allah loves those who act justly.”
(Surah Al-Mumtahanah, 60:8)

This verse advocates kindness and equity towards non-Muslims who live peacefully with Muslims. The Prophet Muhammad īˇē exemplified this through his interactions with Jews and Christians, engaging in dialogue and forming treaties for mutual benefit.

Rights During Conflict

Even during times of war, Islam establishes clear guidelines to ensure humane treatment of non-Muslims. The Prophet Muhammad īˇē instructed his companions:

اØēŲ’Ø˛ŲŲˆØ§ بŲØ§ØŗŲ’Ų…Ų اŲ„Ų„Ų‘ŲŽŲ‡ŲØŒ ŲˆŲŽŲ„ŲŽØ§ ØĒŲŽŲ‚Ų’ØĒŲŲ„ŲŲˆØ§ Ø´ŲŽŲŠŲ’ØŽŲ‹Ø§ ŲŲŽØ§Ų†ŲŲŠŲ‹Ø§ØŒ ŲˆŲŽŲ„ŲŽØ§ ØˇŲŲŲ’Ų„Ų‹Ø§ ØĩŲŽØēŲŲŠØąŲ‹Ø§ØŒ ŲˆŲŽŲ„ŲŽØ§ اŲ…Ų’ØąŲŽØŖŲŽØŠŲ‹ØŒ ŲˆŲŽŲ„ŲŽØ§ ØĒŲŽØēŲŲ„Ų‘ŲŲˆØ§ØŒ ŲˆŲŽŲ„ا ØĒŲŽØēŲ’دŲØąŲŲˆØ§
“Fight in the name of Allah, but do not kill the elderly, children, or women, and do not steal or betray.”
(Sunan Abu Dawood, Hadith 2613)

Islam prohibits targeting non-combatants and destroying crops, homes, or infrastructure. This is a manifestation of mercy and justice even during warfare.

Historical Examples

Throughout Islamic history, the rights of non-Muslims were upheld in diverse societies. Notable examples include:

  • Treaty of Najran: The Prophet Muhammad īˇē granted the Christians of Najran the freedom to practice their religion and guaranteed their safety.
  • Caliph Umar’s Pact with Jerusalem: When Jerusalem was conquered, Umar ibn al-Khattab ensured the Christians could maintain their places of worship and live without fear.
  • Andalusian Tolerance: In Muslim Spain, Jews, Christians, and Muslims coexisted, contributing to advancements in science, art, and culture.

Conclusion: The rights of non-Muslims in Islam

Islam’s emphasis on justice, mercy, and coexistence forms the foundation of its treatment of non-Muslims. The rights granted to non-Muslims in Islam—spanning freedom of religion, protection of life and property, social harmony, and justice—are deeply rooted in the Quran and Sunnah. These principles are not mere theoretical ideals but were actively practiced by the Prophet Muhammad īˇē and his successors, setting a timeless example for humanity.

The Quran commands fairness and compassion in dealing with others, regardless of their faith:

ØĨŲŲ†Ų‘ŲŽ اŲ„Ų„Ų‘ŲŽŲ‡ŲŽ ŲŠŲŽØŖŲ’Ų…ŲØąŲ بŲØ§Ų„Ų’ØšŲŽØ¯Ų’Ų„Ų ŲˆŲŽØ§Ų„Ų’ØĨŲØŲ’ØŗŲŽØ§Ų†Ų
“Indeed, Allah commands justice and good conduct.”
(Surah An-Nahl, 16:90)

The Prophet Muhammad īˇē reinforced this by stating:

Ų…ŲŽŲ†Ų’ Ų‚ŲŽØĒŲŽŲ„ŲŽ Ų…ŲØšŲŽØ§Ų‡ŲØ¯Ų‹Ø§ Ų„ŲŽŲ…Ų’ ŲŠŲŽØąŲŽØŲ’ ØąŲŽØ§ØĻŲØŲŽØŠŲŽ اŲ„Ų’ØŦŲŽŲ†ŲŽŲ‘ØŠŲ
“Whoever kills a person under a covenant (a non-Muslim under Muslim protection) will not smell the fragrance of Paradise.”
